Thank you for choosing Videocontentstreaming , ServiStreaming and AudioRecord, services provided by MS Music and Promotion LLC, a Florida limited liability company ("Company").
These Terms and Conditions govern the use of all streaming, broadcasting, recording, media monitoring, and related services provided by the Company, including but not limited to ServiStreaming and AudioRecord.
By purchasing, subscribing to, or using any of our services, the customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
The customer is solely responsible for all content streamed, uploaded, recorded, broadcast, transmitted, or otherwise distributed through our services and for any consequences resulting from the publication or transmission of such content.
The customer represents and warrants that they own or have obtained all licenses, rights, permissions, and authorizations necessary to stream, record, distribute, broadcast, and publish the content submitted through our services.
The customer is solely responsible for obtaining and maintaining any required music licenses, broadcasting rights, royalties, permissions, and authorizations required under the laws and regulations applicable in their country or jurisdiction.
MS Music and Promotion LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).
Upon receiving any copyright complaint, DMCA notice, allegation of infringement, or claim involving unlawful activity, the Company reserves the right to suspend, restrict, remove content, or terminate services without prior notice.
Customers may not use the services for copyright infringement, unauthorized broadcasting, fraud, abuse, illegal activities, malware distribution, or any activity prohibited by applicable laws.
Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
MS Music and Promotion LLC, its owners, officers, employees, affiliates, contractors, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of the services or from content supplied by customers.
The customer agrees to defend, indemnify, and hold harmless MS Music and Promotion LLC and its owners, officers, employees, affiliates, contractors, agents, and partners from and against any claims, liabilities, damages, losses, expenses, and attorneys' fees arising from content supplied by the customer or from violations of applicable laws or third-party rights.
Unless otherwise required by law, all payments are final and non-refundable.
MS Music and Promotion LLC reserves the right to suspend or terminate services immediately and without prior notice whenever necessary to protect the Company or comply with applicable laws.
These Terms and Conditions shall be governed and construed in accordance with the laws of the State of Florida and the laws of the United States.
Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
